Terms and Conditions

By applying to Open a New Account, you as User represent that you are an attorney licensed to practice law in the state in which you practice. In consideration of our accepting your application and issuing a User Number for your account, you agree to the following:

1. No Warranties. The Qualified Domestic Relations Order (QDRO) you prepare as a QDROS On-Line User is intended to comply with the requirements of Internal Revenue Code Section 414(p) (26 U.S.C. §414(p)) and therefore to be accepted by the Plan Administrator under IRC Section 414(p)(6)(a)(ii). The online edit capability available to you as User allows immediate revision of the QDRO to accommodate a given Plan's procedures; and, the review service provided by QDROS, Inc. will assist the User in that effort. However, QDROS, Inc. cannot and does not warrant that the QDRO you as User prepare will in fact be entered by a court or accepted by the Plan Administrator as a Qualified Domestic Relations Order.

2. Remedies Limited. QDROS, Inc. shall not be liable for any incidental or consequential damages resulting from the use or attempted use of any QDRO prepared by a User of QDROS On-Line. The User's exclusive remedy for any breach of warranty is limited to refund of the purchase price.

3. Limitation of Action. Any action against QDROS, Inc. must be commenced within one (1) year after the User removes the DRAFT STAMP and receives his or her court-ready QDRO.

4. Jurisdiction and Venue. The Circuit Court for St. Louis County, Missouri shall have exclusive jurisdiction of any action against QDROS, Inc.

5. No Attorney-Client Relationship. The Participant, the Alternate Payee and their respective counsel are solely responsible for determining whether the QDRO prepared by the QDROS On-Line User accurately reflects the intent of the parties or the terms of any order with regard to the assignment of benefits in the divorce or dissolution of marriage proceeding in which the QDRO is intended to be used. QDROS, Inc. is not rendering legal advice to the User or the User's client, and no attorney-client relationship results from the User's purchase of the services provided by QDROS, Inc.
